Referral Program Terms & Conditions

These Referral Program Terms and Conditions (“Terms”) govern participation in the Fully Loaded Hitting, LLC (“Fully Loaded Hitting”) Referral Program (“Program”). By participating in the Program, you agree to these Terms.

 

1. Eligibility

​

The Program is available to current Fully Loaded Hitting clients who meet the eligibility requirements below.

​

To be eligible to earn or receive a referral reward, the referring client must have:

 

  1. Actually attended and completed their own first lesson with Fully Loaded Hitting; and

  2. Successfully paid for that lesson.

 

Scheduling a lesson, creating an account, completing onboarding, submitting required documents, or otherwise becoming a prospective client does not establish eligibility for referral rewards.

 

For purposes of these Terms, a payment is considered successfully completed when Fully Loaded Hitting has received the applicable payment and the payment has not failed, been declined, reversed, refunded, disputed, charged back, or otherwise remained unpaid.

 

Additional eligibility requirements include:

 

  • Referred individuals must be new clients who have never previously trained with Fully Loaded Hitting.

  • Self-referrals are not permitted.

  • Participants must be at least 18 years of age or participate with the consent of a parent or legal guardian.

  • Referrals must be made in good faith and comply with all Program requirements.

 

2. Referral Qualification

​

A referral qualifies for a reward only when the referred individual:

 

  1. Actually attends and completes their first lesson with Fully Loaded Hitting;

  2. Successfully pays for that first lesson; and

  3. Completes both requirements within 30 calendar days of their initial contact or inquiry with Fully Loaded Hitting.

 

An inquiry, referral submission, scheduled lesson, account creation, completion of onboarding, or other expression of interest does not constitute completion of a first lesson and does not, by itself, qualify the referring client for a reward.

 

30-Day Qualification Window

 

The referred individual's 30-calendar-day qualification period begins on the calendar date of their first contact or inquiry with Fully Loaded Hitting, regardless of when the referral is communicated, submitted, or identified.

 

The referred individual must actually attend and successfully pay for their first lesson within that 30-calendar-day period.

 

If the referred individual does not satisfy both requirements within the 30-day qualification period:

 

  • The referral does not qualify for a reward;

  • No free lesson is earned based on that referral; and

  • The individual's later participation or enrollment with Fully Loaded Hitting does not reactivate, extend, restart, or otherwise create eligibility for a reward based on the original referral.

 

Scheduling a first lesson within the 30-day qualification period is not sufficient if the lesson itself occurs after the qualification period expires.

 

All scheduling is subject to Fully Loaded Hitting availability. An inability to schedule or complete the referred individual's first lesson within the qualification period, including because an available lesson time cannot be provided, does not extend, pause, or restart the 30-day qualification period.

 

3. Referral Rewards

 

Each successfully qualified referral entitles the eligible referring client to one free lesson, subject to these Terms and Fully Loaded Hitting availability.

 

A referral reward is not earned until the referred individual has completed and successfully paid for their qualifying first lesson in accordance with Section 2.

 

Referral rewards:

 

  • Have no cash or resale value;

  • Are non-transferable;

  • May only be applied to eligible services as determined by Fully Loaded Hitting;

  • May not be split or exchanged for cash, account credit, or another benefit unless expressly authorized by Fully Loaded Hitting;

  • May not be combined or stacked with other promotions, discounts, credits, offers, or referral rewards unless expressly authorized by Fully Loaded Hitting; and

  • May not be used to avoid, offset, or replace any applicable charge or fee, including late-cancellation or no-show charges under the Fully Loaded Hitting Cancellation Policy.

 

Referring clients may earn an unlimited number of referral rewards unless Fully Loaded Hitting establishes a different limit under these Terms. Only one referral reward may be earned for each successfully referred client, and the same referred client may not be counted multiple times.

 

Households With Multiple Participants

 

For clients with more than one child training with Fully Loaded Hitting, each successful referral entitles the referring household to one free lesson total.

 

The reward may be applied to only one eligible participant within the referring household. Lessons for additional participants remain subject to the applicable standard rate.

 

Referral rewards are issued per qualifying referral, not per participant, and may not be split, duplicated, transferred, or applied across multiple participants, lessons, or accounts.

 

4. Claiming & Using Referral Rewards

 

Once the referred individual actually completes and successfully pays for their qualifying first lesson, the referring client's 30-calendar-day referral reward redemption period begins.

 

The referral reward must be both claimed and actually used by attending the applicable free lesson within those 30 calendar days.

 

To claim a referral reward, Fully Loaded Hitting must be notified of the applicable referral by the referring client or referred client within the 30-day redemption period and sufficiently in advance for the reward to be identified and applied, subject to availability.

 

Merely claiming, requesting, or scheduling the free lesson within the 30-day period does not preserve or extend the reward. The free lesson itself must actually occur within the applicable 30-calendar-day redemption period.

 

If the free lesson is not actually attended within the applicable 30-calendar-day period, the reward automatically expires and is forfeited.

 

Scheduling & Availability

 

All referral reward lessons are subject to Fully Loaded Hitting scheduling availability. 

 

Earning a referral reward does not guarantee that Fully Loaded Hitting will have an available lesson time that accommodates the referring client's schedule before the reward expires.

 

The 30-calendar-day redemption period will not be extended, paused, restarted, or otherwise modified because of scheduling limitations or lack of availability, regardless of the reason.

 

If Fully Loaded Hitting is unable to schedule the referring client for an eligible free lesson that occurs before the applicable expiration date, the referral reward will still expire at the end of the 30-calendar-day redemption period.

 

Clients are encouraged to claim and schedule earned referral rewards as soon as possible.

 

5. Payment Reversals, Refunds & Invalidated Referrals

 

A referral reward is conditioned on successful payment of the referred individual's qualifying first lesson.

 

If the qualifying payment fails, is declined, refunded, reversed, disputed, charged back, or otherwise becomes unpaid, Fully Loaded Hitting may deny, revoke, or void the associated referral reward.

 

If a referral reward has already been scheduled, applied, or used before Fully Loaded Hitting becomes aware that the qualifying payment was unsuccessful or subsequently reversed, refunded, disputed, or charged back, Fully Loaded Hitting may revoke the reward and, where applicable, charge the standard rate for the lesson to which the invalid reward was applied, subject to applicable law.

 

6. Limitations & Restrictions

 

Fully Loaded Hitting reserves the right to:

 

  • Establish or modify limits on the number of referrals or rewards a client may earn;

  • Verify referral eligibility, first-contact dates, lesson completion, payment status, and compliance with these Terms;

  • Determine whether a referral satisfies Program requirements;

  • Deny, revoke, or void rewards resulting from suspected or confirmed abuse, fraud, misrepresentation, manipulation, or misuse; and

  • Disqualify participants who attempt to circumvent Program requirements.

 

Referrals must be made in good faith.

 

Any attempt to manipulate, exploit, misrepresent, duplicate, or circumvent the Program, including attempts to alter the applicable qualification or redemption periods, may result in disqualification and forfeiture of applicable rewards. Fully Loaded Hitting's records regarding initial contact dates, lesson attendance, payment status, reward issuance, and reward use will be used to administer the Program, subject to correction of demonstrated errors.

 

7. Program Changes & Termination

 

Fully Loaded Hitting may modify, suspend, restrict, replace, or terminate the Program at any time, with or without prior notice, except where notice is required by applicable law.

 

Changes may include modifications to eligibility requirements, qualifying activities, reward amounts or types, redemption requirements, Program limits, or other Program terms.

 

Changes apply prospectively unless otherwise stated by Fully Loaded Hitting or required by applicable law and do not guarantee the continued availability or honoring of pending, unclaimed, unused, or unredeemed rewards.

 

Continued participation in the Program following an effective change constitutes acceptance of the updated Terms to the extent permitted by applicable law.

 

8. Non-Waiver

 

Failure or delay by Fully Loaded Hitting to enforce any requirement, restriction, deadline, consequence, or other provision of these Terms on one or more occasions does not constitute a waiver and does not prevent Fully Loaded Hitting from enforcing that provision in the future.

 

Any exception, accommodation, extension, permission, or other discretionary treatment provided in a particular situation does not create an entitlement to the same or similar treatment in the future.

 

Prior acceptance of a referral, issuance of a reward, or decision not to enforce a Program requirement does not modify these Terms or establish eligibility for future referrals or rewards.

 

9. Tax Responsibility

 

Participants are solely responsible for any applicable federal, state, or local tax obligations associated with referral rewards.

 

10. No Guarantee of Participation or Reward

 

Participation in the Program does not guarantee:

 

  • Acceptance of a referred individual as a Fully Loaded Hitting client;

  • Availability of a lesson or particular lesson time;

  • Completion of a qualifying lesson within the 30-day qualification period;

  • Availability of a free lesson within the 30-day redemption period; or

  • Issuance or continued validity of a referral reward when Program requirements have not been satisfied.

 

Fully Loaded Hitting retains discretion over client acceptance, scheduling, Program administration, and eligibility determinations, subject to these Terms and applicable law.
